1. Acceptance of Terms

By accessing or using Advantch ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may modify these Terms at any time. Continued use after changes constitutes acceptance of the modified Terms.

2. Description of Service

Advantch provides a platform for building and deploying SaaS and AI-powered applications. The Service includes web-based tools, APIs, integrations, and related documentation.

3. Account Registration

• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must be at least 16 years old to use the Service.
• You may not use another person's account without permission.

4. Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to the Service or other systems
• Interfere with or disrupt the Service or servers
• Use the Service for illegal, fraudulent, or abusive purposes
• Scrape, crawl, or harvest data without authorization
• Resell or redistribute the Service without written consent
• Use automated means to access the Service in violation of these Terms

5. User Content

Ownership: You retain ownership of content you create or upload to the Service ("User Content").

License: By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process such content solely to provide the Service.

Responsibility: You are solely responsible for your User Content and warrant that you have all necessary rights to upload and use it.

6. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by Advantch and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service except as expressly permitted.

7. Payment and Billing

• Paid features require a valid payment method.
• Fees are billed in advance on a subscription basis.
• All payments are non-refundable except as required by law or stated in our refund policy.
• We may change pricing with at least 30 days' notice.
• Failure to pay may result in suspension or termination of your account.

8. Cancellation and Termination

By You: You may cancel your account at any time through your account settings. Cancellation takes effect at the end of the current billing period.

By Us: We may suspend or terminate your account for violation of these Terms, non-payment, or other reasons at our discretion. We will provide notice when reasonably possible.

Effect of Termination: Upon termination, your right to use the Service ceases. We may delete your data after a reasonable retention period.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVANTCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Advantch and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Advantch is incorporated, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration or in the courts of the applicable jurisdiction, at our election.

13. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Advantch regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights freely.
